These terms and conditions of use (“Terms of Use”) govern your use of our online interfaces, digital properties owned and controlled by Synapticure (“SynaptiCure”) including the website located at www.synapticure.com, and the non-clinical services provided through the SynaptiCure website. Your compliance with these Terms of Use is a condition to your use of the Digital Services. If you do not agree to be bound by the Terms of Use, promptly exit the Digital Services. Please also consult our Privacy Policy for a description of our privacy practices and policies.

SynaptiCure does not provide medical advice or care. Any telemedicine consults obtained through our Digital Services are provided by independent medical practitioners.

Binding Arbitration. These Terms of Use provide that all disputes between you and SynaptiCure will be resolved by BINDING ARBITRATION.

1. Ownership of the Digital Services

All pages, features, and content within these Digital Services and any material made available for download are the property of SynaptiCure. The Digital Services are protected by copyright and trademark laws.

2. Availability of Services

SynaptiCure operates subject to state and federal regulations, and the Digital Services may not be available in your state.

3. Access to Digital Services, Security and Restrictions; Passwords

You are prohibited from violating or attempting to violate the security of the Digital Services. You agree to protect the confidentiality of your user ID and password.

4. Accuracy and Integrity of Information; Colors

Although SynaptiCure attempts to ensure the integrity and accuracy of the Digital Services, it makes no representations, warranties, or guarantees whatsoever as to correctness or accuracy.

5. Typographical Errors and Incorrect Pricing

In the event a product or service is listed at an incorrect price due to typographical error, we reserve the right to refuse or cancel any such orders.

6. Account Set-Up.

You agree to provide true, accurate, current, and complete information when registering to use the Digital Services.

7. Order Acceptance

We reserve the right to refuse or cancel any order for any reason.

8. Online Payments

You can purchase services on the Digital Services. We accept credit and debit cards issued by U.S. banks.

SynaptiCure makes no representations about any other website that you may access through these Digital Services.

10. Disclaimer of Warranties

SYNAPTICURE DOES NOT WARRANT THAT ACCESS TO OR USE OF THE DIGITAL SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.

11. No Medical Advice

The Providers are independent of SynaptiCure and are merely using the Digital Services as a way to communicate with you.

Telehealth involves the delivery of healthcare services using electronic communications.

SynaptiCure is not an insurer. The services provided are not insurance products.

12. Limitation of Liability Regarding Use of Digital Services

SYNAPTICURE AND ANY THIRD PARTIES MENTIONED ON THESE DIGITAL SERVICES ARE NEITHER RESPONSIBLE NOR LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE, OR OTHER DAMAGES.

13. Dispute Resolution; Arbitration Agreement.

You and SynaptiCure agree that any dispute shall be determined by binding arbitration.

14. Supplemental Terms Applicable to Providers

These terms apply to Providers using the Digital Services.

15. Consent to Receive Calls and Text Messages and Video Recording

By providing your mobile number, you consent to be contacted by SynaptiCure.

16. CAN-SPAM Act and Telephone Consumer Protection Act Compliance

SynaptiCure is committed to compliance with the CAN-SPAM Act and the Telephone Consumer Protection Act.

17. Electronic Communications

When you use the Digital Services, you are communicating with us electronically.

18. Force Majeure

SynaptiCure is not liable for any failure to perform due to causes beyond its reasonable control.

19. External Services.

The Digital Services may enable access to third-party services and websites.

20. Indemnification

You agree to defend, indemnify, and hold SynaptiCure harmless from any claims arising out of your use of the Digital Services.
